These Terms & Conditions (“Terms”) govern the use of the Fit369 mobile application (“App”) by registered Personal Trainers (“PT”, “Trainer”, “You”). By creating a PT account, purchasing a subscription, accessing PT features, or offering services through the App, you agree to these Terms.

You confirm that you have read, understood, and accepted these Terms by ticking the acceptance box. A digital signature is not required. PTs are not employees of Fit369.

1. DEFINITIONS

“Fit369”, “We”, “Our”, “The Company” – the owner and operator of the App. “PT”, “Trainer” – a freelancer or independent contractor who uses the App to offer training services. “User” or “Client” – individuals who use the App to find and train with PTs. “Services” – features within the App including PT profiles, bookings, messaging, availability, payments, self record revenue summary, and training programs. “Subscription” – recurring monthly fee that gives PTs access to PT features. “Platform” – the Fit369 App, website, and related systems.

2. RELATIONSHIP BETWEEN FIT369 AND THE PT

2.1 Independent Contractor Status

You acknowledge that:
• You are not an employee of Fit369.
• You are a freelancer / independent contractor.
• You are responsible for your own tax, permits, qualifications, and legal compliance.

2.2 No Employment Benefits

PTs are not entitled to:
• Salary
• Visa sponsorship
• Insurance
• End-of-service
• Any employment rights

Fit369 only provides a technology platform to connect PTs and Users.

3. ELIGIBILITY REQUIREMENTS

To register as a PT, you confirm that:
• You are at least 18 years old
• You have the legal right to work as a freelancer or trainer in your country
• You possess valid fitness certifications required in your region
• You will provide accurate, truthful information
• You will only offer services permitted under local laws

4. DOCUMENT VERIFICATION

Depending on your country:

4.1 United Arab Emirates (UAE)

PTs operating within the UAE (in-person or online to UAE residents) may be required to upload:
• REPs UAE Certificate
• First AID – CPR Certificate
• Emirates ID
• Visa / Passport Copy
• Any additional documents required by UAE law
Fit369 reserves the right to request extra verification.

4.2 Non-UAE Countries

PTs outside UAE may be required to provide:
• Fitness certification
• First AID – CPR Certificate
• National ID or passport
• Proof of training experience

4.3 Online-Only PTs

If you choose “Online Only”, you must still comply with
• Local laws of your country
• Regulations of the client’s country (where applicable)

5. SERVICES PROVIDED BY FIT369

Fit369 provides PTs with:
• PT Profile
• User Bookings
• Messaging
• Self record revenue summary tracking
• Calendar & availability
• Program creation tools for there clients not FIT369 User
• Notification system
• In-app PT–client communication
Fit369 does not:
• Guarantee bookings
• Guarantee earning
• Provide job placements
• Train or certify PTs

6. SUBSCRIPTION FEES

6.1 Monthly, 6 months or 12 months Subscription

PTs must pay the active subscription fee (e.g. starting with AED 369 Monthly) to access PT features.

6.2 Automatic Renewal

Subscriptions renew automatically unless cancelled in the App Store / Google Play.

6.3 Refunds

Fit369 does not provide refunds for:
• Active subscriptions
• Accidental purchases
• Unused periods
• Billing errors caused by incorrect app store settings

7. PT RESPONSIBILITIES

You agree to:

7.1 Provide Accurate Information

All profile information must be truthful, including:
• Certifications
• Experience
• Pricing
• Availability

7.2 Maintain Professional Conduct

You must:
• Behave respectfully
• Keep communication clean
• Avoid harassment or misconduct

7.3 Deliver Services Safely

You are fully responsible for:
• Training methods
• Assessing client readiness
• Avoiding unsafe exercises
• Modifying programs for client injuries or health issues

7.4 Follow Local Laws

You must:
• Follow fitness regulations in your country
• Acquire necessary licenses
• Not perform activities that violate local laws
Fit369 is not responsible for any legal issues caused by non-compliance.

8. PAYMENTS & EARNINGS

8.1 Direct Payments

Fit369 does not collect PT earnings. Users pay PTs directly (bank transfer, cash, etc.) unless otherwise implemented.

8.2 Proof of Payment

Users may upload payment screenshots. Fit369 does not verify or guarantee payment accuracy.

8.3 PT Revenue

PTs must record earnings honestly. Fit369 is not responsible for disputes between clients and PTs.

9. ONLINE TRAINING

If you offer online training, you agree:
• To provide safe and clear instructions
• To ensure you have a proper environment and equipment
That Fit369 is not liable for injuries or issues occurring during online sessions

10. LIABILITY & DISCLAIMER

Fit369 is not liable for:
• Injuries during PT–client sessions
• Misconduct by PTs or Users
• Payment disputes
• False certifications uploaded by PTs
• Legal violations by PTs
• Incorrect training advice
• User dissatisfaction
• Loss of revenue
• Technical errors or outages
The PT accepts full responsibility for all training services they provide.

11. PT CONTENT & INTELLECTUAL PROPERTY

PTs may upload:
• Images
• Program templates
• Videos
• Exercise instructions
• You grant Fit369 a license to display such content inside the App.

12. TERMINATION

Fit369 may suspend or terminate your PT account if:
• You violate these Terms
• Provide false documents
• Break local laws
• Receive repeated complaints
• Engage in unsafe or unethical conduct
PTs may delete their account anytime.

13. DISPUTES BETWEEN USERS AND TRAINERS

Fit369 is not involved in:
• Payment disputes
• Training quality issues
• Cancellation issues
• Behavioural complaints
PTs must resolve disputes directly with Users.

14. MODIFICATIONS TO TERMS

Fit369 may update these Terms at any time. PTs will be notified through the App.

15. ACCEPTANCE

By ticking “I Accept the Terms & Conditions,” you confirm that:
• You have read and understood these Terms
• You agree to comply
• You understand you are a freelancer, not an employee
• You accept all responsibilities related to training clients
A digital tick is sufficient; no signature required.
